Before you point a camera at staff
Workplace Surveillance Obligations in NSW
If your cameras cover areas where your own people work, the Workplace Surveillance Act 2005 (NSW) puts obligations on you as the employer. They are easier to meet at design stage than afterwards.
- At least 14 days' written notice before camera surveillance of employees starts - shorter only if the employee agrees in writing.
- That notice has to state the kind of surveillance, how it will be carried out, when it starts, whether it is continuous or intermittent, and whether it is ongoing or for a limited period.
- Cameras must be visible, and there must be signage at the entrances.
- Camera surveillance is prohibited outright in toilets, bathrooms and change rooms.
We factor those obligations into the design: where the cameras point, whether they sit plainly visible rather than tucked out of sight, and where signage will need to go. If a camera position looks like it will cause you a problem, we raise it at the site assessment - before any cable is run, while it is still cheap to move.
